The Republic of Paraguay provides protection for workers and employees in the form of paid annual leave and paid national holidays. The law requires payment for these holidays in addition to the required number of annual vacation days. The law relates vacation days to tenure.

The work week in Paraguay is a maximum six-day, 48 hour work week, although many employees have a five day work week. Sunday is recognized as the national day of rest, and work on Sundays require a holiday differential of 100 percent. Article 194 of Labor Code states establishes normal working hours for a worker at eight hours per day, six days per week, and up to a total of 48 hours.

The laws of Paraguay require overtime pay for hours in excess of eight hours per day and for hours in excess of 48 hours per week. The legal rate for overtime pay requires a fifty percent hourly differential, 150 percent of base salary or wages. With a six day, 48 hour week, the labor law limits overtime hours to special circumstances. Overtime may not exceed three hours per day; employers may not require overtime more than three days per week. The overall aggregate may not exceed 57 hours per week. Employers must pay 150 percent of wages as overtime pay. The law does not permit overtime for employees less than 18 years of age.
