Panama’s Labour Code, established in 1971 governs the country’s labour laws. The Code outlines the rights and obligations of employers and employees in both the public and private sectors.
The majority of employers in Panama require employees to enter into a written employment contract at the beginning of employment. The contract sets forth the employment relationship and provides guidelines set forth by the Labour Code pertaining to employee salaries, benefits, bonuses and entitlement to paid vacation and holidays. Although collective bargaining agreements are common in Panama among trade unions, they generally apply only to manufacturing, construction and transportation industries.
Employees in Panama are entitled to 13 paid public holidays. If a public holiday falls on a Sunday, the following Monday is observed as the holiday. In addition to the 13 statutory public holidays, employees are allowed time off to celebrate the Presidential Inauguration, which takes place every five years. Employees required to work on a public holiday are compensated at the rate of double the regular salary, known as double time.
As is common practice in most Latin American countries, Panama provides all employees with 13 months’ pay for every 12 months of consecutive employment. The extra month salary can be paid as a Christmas bonus or may be proportioned into three equal installments, payable in April, August and December. According to Panama’s Labour Code, employees are allowed statutory paid vacation amounting to 30 days per year. Employers may allow employees to split vacation time into two equal periods. In the event an employment contract is terminated, employees are paid for any unused vacation days.
